Terms of Service

Please use LexaLingo to learn—not to harm the service or the people behind it.

Effective August 20, 2026

1. Agreement and operator

These Terms of Service (“Terms”) govern your access to and use of the LexaLingo mobile applications, website, learning content, account features, and related services (together, the “Service”). The Service is operated by LexaLingo LLC (“LexaLingo,” “we,” “us,” or “our”). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If the law where you live requires you to be older to consent to online services or personal-data processing, that older age applies. If you have not reached the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms.

3. Accounts and device data

An account is optional unless a feature says otherwise. You are responsible for maintaining control of your email, Apple account, Google account, devices, and active sessions. Do not access another person’s account or allow another person to misrepresent themselves through yours. Tell us promptly if you reasonably believe your account or device has been compromised.

Signing out does not erase learning data already stored on a device. Account deletion is permanent and may make synchronized progress unrecoverable. Review the account-deletion page before confirming deletion.

4. License to use LexaLingo

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for your own lawful language learning. No ownership rights are transferred to you. LexaLingo’s software, designs, text, lessons, databases, audio, images, illustrations, trademarks, and other materials are owned by us or our licensors and are protected by applicable intellectual-property laws.

5. Acceptable use

You may not, and may not help anyone else to:

  • access accounts, systems, data, or nonpublic parts of the Service without authorization;
  • probe, scan, exploit, or test vulnerabilities without our prior written permission;
  • bypass authentication, access controls, rate limits, content controls, technical restrictions, or store protections;
  • introduce malware, harmful code, automated traffic, denial-of-service activity, or anything that disrupts or degrades the Service;
  • scrape, crawl, harvest, copy, extract, mirror, republish, sell, license, or build a competing dataset or service from LexaLingo content except where applicable law expressly permits it;
  • reverse engineer, decompile, or attempt to derive source code, models, databases, or protected methods except to the limited extent a law prohibits that restriction;
  • use the Service or its content to train, evaluate, or improve a commercial model, automated system, or competing product without our written permission;
  • impersonate another person, misrepresent an affiliation, commit fraud, violate law, infringe rights, or use the Service to harm, threaten, or deceive anyone; or
  • use automated means to create accounts, manipulate learning records, overwhelm support, or evade enforcement.

If you discover a security issue, stop testing, avoid accessing or changing other people’s data, and report it through our security contact.

6. Enforcement

We may investigate suspected misuse and may restrict, suspend, or terminate access when reasonably necessary to protect users, the Service, our rights, or others; comply with law; or enforce these Terms. We may preserve and disclose information when reasonably necessary to investigate abuse, prevent fraud or security threats, respond to lawful process, or protect rights and safety. We are not required to provide advance notice when doing so would create risk, undermine an investigation, or be prohibited by law.

7. Learning information is educational

LexaLingo is an educational tool, not an accredited school, testing authority, translator, or provider of legal, medical, financial, immigration, or other professional advice. Language, translations, pronunciations, explanations, and learning recommendations may contain errors or may not fit every context. You remain responsible for verifying important information and for how you use it. We do not guarantee a particular score, credential, fluency level, or learning outcome.

8. Feedback

If you voluntarily send ideas, suggestions, or feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use, adapt, and incorporate it without restriction or compensation. This does not transfer ownership of your personal information or private learning records.

9. Third-party services and stores

The Service may rely on or link to third-party services, including Apple, Google, Supabase, hosting providers, and app stores. Their own terms and privacy practices apply to their services. We do not control third-party services and are not responsible for their independent acts or availability. If you download the app through Apple or Google, the applicable store terms also apply; these Terms are between you and LexaLingo LLC, not the store operator.

10. Changes and availability

We may improve, add, remove, or discontinue features or content, and we may update these Terms. If a change materially affects your rights, we will provide notice appropriate to the change before it takes effect where required by law. Continued use after the effective date means you accept the updated Terms. We may interrupt the Service for maintenance, security, legal, or operational reasons and do not promise uninterrupted availability.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be error-free, secure, uninterrupted, or that content will always be complete or accurate. Some jurisdictions do not allow certain disclaimers, so some of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, LexaLingo LLC and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the claim or US $100.

These limits do not exclude liability that cannot lawfully be excluded or limited, including rights you may have under mandatory consumer-protection law.

13. Your responsibility for claims

To the extent permitted by law, you agree to defend, indemnify, and hold harmless LexaLingo LLC and its affiliates from third-party claims, losses, and reasonable costs arising from your unlawful use of the Service, your material violation of these Terms, or your infringement of another person’s rights. This does not apply to the extent a claim was caused by our own unlawful conduct, negligence, or breach of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of Florida, United States, without regard to conflict-of-law rules, except where mandatory law in your place of residence provides otherwise. Courts with lawful jurisdiction in Florida, United States may hear disputes, but nothing here prevents either party from seeking urgent injunctive relief or using an available small-claims process. Before filing a formal claim, please contact us and give us a reasonable opportunity to resolve the issue informally.

15. General terms

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganization, financing, merger, acquisition, or sale of the Service. These Terms and the Privacy Policy form the entire agreement about the Service unless a separate written agreement applies.
